Terms & Conditions

These terms and conditions (the “Agreement”) govern the use of the Software as a Service (SaaS) system for Daycare Promotion (the “System”) provided by [Daycare Promotion] (“Provider”) to daycare service providers (the “User” or “Customer”). By using the System and registering domain names via the system, the User agrees to abide by the following terms and conditions:

1. Use of the System

1.1. The User is granted a non-exclusive, non-transferable licence to use the System for the purpose of promoting and marketing a daycare service.

1.2. The User agrees not to use the System for any unlawful or unauthorized purpose.

2. Account Setup and Security

2.1. The User is responsible for maintaining the confidentiality of login credentials and account information. Any actions or activities that occur under the User’s account are their responsibility.

2.2. The User must immediately notify the Provider of any unauthorized use of their account or any other breach of security.

3. Payment and Fees

3.1. The User agrees to pay the fees for using the System as specified in the pricing plan selected. Fees are non-refundable and subject to change upon notice from the Provider.

3.2. The Provider will charge the User’s selected payment method in accordance with the billing cycle chosen by the User.

4. Data Privacy and Security

4.1. The Provider will take reasonable measures to secure User data, but the User understands that no online service is completely immune to security breaches.

4.2. The User is responsible for maintaining the privacy and security of the data they input into the System.

5. Content and User Conduct

5.1. The User is solely responsible for the content they upload, store, or transmit through the System.

5.2. The User agrees not to use the System to post, share, or distribute any content that is unlawful, harmful, or infringes upon the rights of others.

6. Support and Maintenance

6.1. The Provider will make reasonable efforts to ensure the System is available for use. However, the System may be temporarily unavailable for scheduled maintenance or due to unforeseen technical issues.

6.2. The Provider will provide technical support to the User as described in the service level agreement.

7. Termination

7.1. The User may cancel their subscription at any time, but no refunds for prepaid fees will be issued.

7.2. The Provider may terminate the User’s access to the System at any time for violation of these terms and conditions.

8. Domain name registration

8.1. Domain names can be registered on the customer’s behalf. Should the customer terminate the service the domain can be transferred to the customer at a cost of $40.

9. Changes to Terms and Conditions

9.1. The Provider reserves the right to modify these terms and conditions at any time. Users will be notified of any changes, and continued use of the System after notification constitutes acceptance of the revised terms.

10. Limitation of Liability

10.1. The Provider shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the System.

11. Governing Law

11.1. This Agreement is governed by and construed in accordance with the laws of Ireland.

12. Entire Agreement

12.1. This Agreement constitutes the entire understanding between the User and the Provider and supersedes all prior agreements, representations, and warranties.

By using the System, the User acknowledges that they have read, understood, and agreed to these terms and conditions. If the User does not agree with these terms, they should not use the System.
